Dolphin Blue Rewards Program Terms and Conditions

Subject to the terms and conditions set forth below, effective January 3, 2025 members of Dolphin Blue Loyalty Rewards Program will earn points in connection with the purchase of qualifying products at DolphinBlue.com.  Dolphin Blue Loyalty Rewards Program and points earned begin on January 3, 2025 and do not apply to any orders placed before January 3, 2025. These Terms govern membership in the Dolphin Blue Loyalty Rewards Program.

Membership

  1. Free Membership.

No purchase is necessary to obtain membership or enroll in the Dolphin Blue Loyalty Rewards Program ("Dolphin Blue Loyalty Rewards" or the "Program").

  1. Earning Rate.

You must be age 18 years or older and a resident of the United States to be eligible for membership. Membership in the Program is limited to individuals only and is limited to one account per individual. To enroll in the Program, you must provide your first name, last name, email address, state of residence and optional phone number. The Program is void where prohibited by law. Members are entitled to only one Member Account.

  1. Opening an Account.

Online. You may apply to become a Member of the Program by visiting www.DolphinBlue.com/pages/become-a-member. In order to enroll on the Website, you must first be a registered user of the Website and have a user-name and password.

  1. Membership Account.

If Member surrenders their account and creates a new one, at Dolphin Blue's sole discretion, the Member may be issued points from their other accounts, (including negative balances) to the new Member Account. To ensure proper handling of Member Accounts, lost or stolen accounts must be reported by contacting the Dolphin Blue Customer Service Team at 800-932-7715. The Account remains the property of Dolphin Blue and must be surrendered upon request. No credit or cash will be given for unused points. Program account numbers are not transferable and are not for sale, resale or barter. Dolphin Blue is not responsible for use of a Member's account or redemption of a Member's points in the event the Member's account is stolen and the account is used or the points are redeemed prior to the Member informing Dolphin Blue that the Member's account has been stolen.

  1. Member Information (including Personal Information) and Privacy Policy.

As part of the registration process, you may need to create a Member Account and select a password. You agree to maintain the confidentiality of your password and Member Account, and that you are fully responsible for all activities that occur under your password or Member Account or any other breach of security, and to log out at the end of each session. Dolphin Blue will not be liable for any loss or damage arising from your failure to comply with these Terms and Conditions. If you notify us that you have lost access to your Member Account, we may terminate your Member Account as proscribed in these Terms and Conditions.

Members must keep their Member Account information up-to-date by visiting the Website. If you are a Member of the Program but not a registered user of the Website, you may become a registered user of the Website by clicking the “Account” link in the header of the DolphinBlue.com homepage, then click "Create account" and proceeding through the associated registration prompts. Once you are a registered user of the Website, the "My Account" link will allow maintenance of both site registration and Program associated information. The information you provide as a Member of the Program will be handled according to Dolphin Blue's privacy policy. If a Member’s Account has had no purchase activity for a period of time (such period of time to be determined in Dolphin Blue’s sole discretion), Dolphin Blue reserves the right to cancel the Member’s Account. At such time of cancellation, any accumulated Points/Rewards balance will expire. If a Member’s Account is terminated for inactivity, the Member may re-enroll in the Program, but previously earned Points/Rewards will not be credited and the Member will start with a balance of zero Points/Rewards.

  1. Changes to Loyalty Program.

Dolphin Blue reserves the right to change or modify any of the terms and conditions contained in the Loyalty Program Terms & Conditions, Guidelines and Rules from time to time at any time, without notice, and in its sole discretion. If Dolphin Blue decides to change these Loyalty Program Terms & Conditions, Dolphin Blue will post a new version on the Site and update the date set forth above. ANY CHANGES OR MODIFICATIONS TO THESE LOYALTY PROGRAM TERMS & CONDITIONS, GUIDELINES OR RULES WILL BE EFFECTIVE UPON POSTING OF THE REVISIONS. THE UPDATED LOYALTY PROGRAM TERMS & CONDITIONS WILL REPLACE THE PRIOR VERSION AND ARE APPLICABLE TO ANY FUTURE DISPUTES BETWEEN THE PARTIES, REGARDLESS OF WHEN THE DISPUTED INTERACTIONS AROSE. 

  1. Online Account Maintenance.

Once a Member is a registered user of the Website, members may view a summary of their Account on the Website. After logging onto the Website, simply click on the "Account" link in the header of the Website homepage and change any information, as needed. Members may also view their Dolphin Blue Loyalty Rewards Program points balance, transaction history, and eligibility for bonus point offers on the Website by logging in and clicking on the "Dolphin Blue Loyalty Rewards Program" link in the profile navigation.

  1. Member Cancellation.

Members may cancel their Dolphin Blue Loyalty Rewards Program membership at any time by contacting Dolphin Blue Customer Service Team at 800-932-7715 or by visiting www.DolphinBlue.com/pages/become-a-member. Upon cancellation, any unused points accrued in the Member's account will be forfeited and cannot be redeemed.

Earning Points

  1. General.

Members can earn Dolphin Blue Loyalty Rewards points on all products purchased online (excluding gift cards, taxes & shipping charges). For all online purchases, Members must be a registered user of the Website and be a registered member of Dolphin Blue Loyalty Rewards Program to get credit for online purchases. Members must be signed into this account to receive any credit.

Personal Use Only. The Program and associated Points and benefits are intended for personal use only. The sale or barter of any Dolphin Blue Loyalty Rewards Points or benefits is prohibited. Any personal shoppers or individuals acting on behalf of third-party delivery, fulfillment and/or shopping services may not use their own Account in connection with orders placed by others. We reserve the right to modify or discontinue the Dolphin Blue Loyalty Rewards Program at any time with or without notice, or terminate any membership at any time with or without notice for any reason, including for fraud, abuse, conduct inconsistent with this policy and/or any other Dolphin Blue policies, third-party order fulfillment or delivery policies, for violation of any local, state, or federal laws or ordinances, or for use other than in connection with bona fide orders you personally place.

  1. Earning Rate.

Dolphin Blue Loyalty Rewards. Members earn one (1) point for every one dollar ($1) spent when they purchase: (i) qualifying products online if the Member is logged into the Website and has linked his or her online account to the rewards program. Points are rounded down. For example, if a member spends $19.99, the member will receive 19 points. Calculation is as follows: $19.99 x 1 point per dollar = 19.99 points, which is rounded down to 19 points.

  1. Gift Cards.

When a Member makes a qualifying purchase online using a gift card, the Member will earn points on the amount of the purchase.

  1. Timing of the Addition of Points to Accounts.

Dolphin Blue Loyalty Rewards Member Points.

Online Purchases. Dolphin Blue Loyalty Rewards Member Points earned on the online purchase of qualifying products will be credited within 72 hours after shipping. The timing for issuing points is subject to change.

  1. Exclusions.

Calculation of Dolphin Blue Loyalty Rewards points are based on the price of the purchased product and excludes payment by the Member for shipping charges, and all taxes, including without limitation, federal, state, and local taxes or use taxes. Dolphin Blue Loyalty Rewards points will not be earned on any discounts or other credits offered in connection with a product. For example, if a product that is normally $100 is on sale for $75, a Member will only earn points on the purchase price of $75. Purchases of gift cards, redemption of merchandise vouchers, and any type of price adjustments, including merchandise returns, are not eligible for points. All purchases made: (i) by a Member prior to such member joining the Program, (ii) without applying the Program prior to the transaction made (iii) Online without a Member being logged into the Website with the Member's Dolphin Blue Loyalty Rewards linked to the Member's Online account, are not eligible for Program credit.

  1. Returns.

Points earned for a purchase that is then the subject of a return, refund, or other credit will be deducted from the Member's account in an amount equal to the points earned for the original transaction, including bonus points. If Member’s point balance has been depleted before a return is made and processed, the Member’s account may go negative in points to account for the deduction of points for the returned or refunded product that earned the points.

  1. Bonus Point Promotions.

From time to time, Dolphin Blue may run certain bonus point promotions. Under bonus point promotions, Members can earn additional or "bonus points" in connection with the purchase of certain products at Dolphin Blue online store. When these products are purchased by a Member, the Member will earn bonus points on each product, as specified in the offer. Bonus point promotions are subject to the terms and conditions of the offer and may be offered at any time in Dolphin Blue's sole discretion. If a Member purchases a product during a bonus point promotion and the product comes with an additional, free product, bonus points will not be issued on the retail value of the free product. If a Member redeems points towards the purchase of a bonus point product and pays a portion of the retail price after the points redemption, the Member will receive bonus points on the leftover retail amount paid by the Member. If a Member redeems points towards the purchase of a bonus point product in an amount equal to the full price of the bonus point product, the Member will not earn any bonus points. Members may also earn additional points on non-purchase activities in accordance with the terms published by Dolphin Blue. From time to time, Dolphin Blue may offer Members the chance to win various prizes, including points. Rules and restrictions will apply to such promotions.

Redeeming Points

  1. General.

Points earned by a Member may be redeemed for products or discounts on products Online at DolphinBlue.com.  Minimum order must be $25.00 to redeem points.  Points cannot be redeemed on Gift Card purchases, shipping charges, and/or taxes on DolphinBlue.com.  

  1. Points towards Products.

Members can use their points to reduce the purchase price of a qualifying product free of charge based on the following scale (point values in excess of the below chart values can be found in the Dolphin Blue Member’s account dashboard, based upon the Member’s current points balance):

  • 100 points = $3.00 off
  • 250 points = $8.00 off
  • 500 points = $18.00 off
  • 750 points = $32.00 off
  • 1000 points = $50.00 off
  • 2000 points = $125.00 off

Points can be redeemed, subject to the limitations outlined below, in any combination of the point and increment amounts set forth above. Redemption of points online towards purchases of products is subject to product availability.

  1. Redemption online.

Members may redeem their points on any DolphinBlue.com purchase excluding gift cards. To redeem points through an online purchase, a Member must be a registered user of the Website. Points may only be redeemed on the purchase price of qualifying products and cannot be used towards sales tax, shipping and handling charges or the purchase of gift cards. A Member may redeem up to 2,000 points in a single online purchase. Any remaining points can be redeemed in a future purchase. Minimum order must be $25.00 to redeem points.

  1. Gift cards.

Points cannot be used towards the purchase of gift cards.

  1. Exclusions.

Points accumulated on different Accounts of different Members may not be combined or aggregated to make purchases of products and services or for any other reason. Points earned in a transaction cannot be redeemed in the same transaction.

  1. Points Expiration.

ALL POINTS EXPIRE AT THE END OF THE CALENDAR QUARTER FOLLOWING THE TWELVE (12) MONTH ANNIVERSARY OF THE DATE THE POINTS WERE EARNED BY THE MEMBER.

General

Limitation of Liability YOU UNDERSTAND, ACKNOWLEDGE, AND AGREE THAT YOUR PARTICIPATION AND USE OF THIS PROGRAM IS AT YOUR OWN RISK. TO THE FULLEST EXTENT PROVIDED UNDER APPLICABLE LAW, DOLPHIN BLUE SHALL NOT BE LIABLE FOR ANY SPECIAL, DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES, INCLUDING WITHOUT LIMITATION, LOST REVENUES OR LOST PROFITS, IN ANY WAY DUE TO, RESULTING FROM, OR ARISING IN CONNECTION WITH THIS PROGRAM.

By joining the Dolphin Blue Loyalty Rewards Program, you agree to be bound by the terms and conditions set forth in these Program rules. Except where prohibited by law, Dolphin Blue reserves the right to cancel, modify, or restrict Dolphin Blue Loyalty Rewards Program or any aspect of the Program, including, without limitation, the point conversion ratio and the point expiration policy at any time. Any changes can be made without advance notice. Dolphin Blue may make these changes even though such changes may affect the Member's ability to use points already accumulated. Members are responsible for remaining knowledgeable about the Program Terms and Conditions. A Member's points balance, as reflected in Dolphin Blue's records, shall be deemed correct. Dolphin Blue reserves the right to determine the amount of points in any Member's account based on Dolphin Blue's internal records related to such Member's account. In the event of an inconsistency between the amount accrued in a Member's account as stated on any Member's receipt and Dolphin Blue's internal records, Dolphin Blue's internal records will control. Dolphin Blue assumes no responsibility for errors caused by incorrect Member information. A Member's right to transfer points earned or granted under the Program is strictly limited. The sale of points is prohibited and may result in the confiscation or cancellation of such Member's points as well as suspension or termination of your membership, which in each case shall be final and conclusive. Dolphin Blue may revoke any Member's membership in Dolphin Blue Loyalty Rewards Program at any time if such Member engages in abuse of the Program or fails to follow the terms and conditions of the Program. Fraud or abuse relating to the accrual of points or redemption of rewards may result in revocation of membership in the Program and may affect a Member's eligibility for participation in any other Dolphin Blue program. Dolphin Blue Loyalty Rewards Program points are non-transferable and cannot be redeemed for cash. No interest is paid on Points and/or Rewards subject to applicable laws. Point and/or Reward balances are not your property, and you have no property rights or other legal interest in the Points and/or Rewards. All Points and/or Rewards remain the sole property of Dolphin Blue until redeemed. Your Points and/or Rewards balance or any part of it is not transferable, cannot be brokered, bartered, or sold, and cannot be divided as part of a settlement, legal proceeding or death, and cannot be combined with Points and/or Rewards of any other Participant or participant in the Program. If required under applicable state unclaimed property laws due to non-redemption of your Points and/or Rewards balance over time, we may transfer, report, or convey your Points and/or Rewards balance to a state agency. You should therefore redeem your Points and/or Rewards balance on a regular, continuing basis. We take no responsibility for any loss of Points and/or Rewards balances due to unclaimed property laws. The interpretation and application of the Program's Terms and Conditions are at the sole discretion and determination of Dolphin Blue. Any action arising out of the Program, including but not limited to a breach of these Terms and Conditions, shall be brought before the federal or local courts presiding in Texas, United States, whichever is appropriate, and to whose jurisdiction you consent in such an action. The applicable law in such an action will be the law of the state of Texas, applicable to contracts entered into and to be wholly performed therein without regard to conflict of laws or choice of law principles.

If a dispute should arise between you and Dolphin Blue, we want to provide you with a resolution that is efficient and cost effective. In our experience, almost all customer service disputes can be resolved to your satisfaction by our customer service team, reachable by emailing sales@dolphinblue.com or by calling 800-932-7715.

If your dispute cannot be resolved using our customer service team, these Terms describe how we shall proceed with the resolution of the dispute.

TO THE EXTENT PERMITTED BY APPLICABLE LAWS, YOU AND DOLPHIN BLUE AGREE THAT ANY CAUSE OF ACTION ARISING OUT OF OR RELATED TO THE PROGRAM MUST COMMENCE WITHIN ONE (1) YEAR AFTER THE CAUSE OF ACTION ACCRUES. OTHERWISE, SUCH CAUSE OF ACTION IS PERMANENTLY BARRED.
